4. Service Provision Conditions

4.1 Mandate Acceptance

Legal service provision begins with express acceptance of the mandate, through signing a service agreement or power of attorney.

4.2 Fees

  • • Fees are agreed in advance and in writing
  • • May be fixed, hourly or quota litis (percentage of result)
  • • Include VAT at the legal rate in force
  • • Expenses and costs are billed separately
  • • Advance payment may be requested

4.3 Client Obligations

  • Provide complete and truthful information
  • Make necessary documentation available
  • Meet agreed deadlines
  • Make payments according to agreed terms
  • Communicate relevant changes

5. Confidentiality and Professional Secrecy

VS Advocacia commits to:

  • Maintain absolute confidentiality about all client information
  • Not disclose data or documents to third parties without authorization
  • Protect confidentiality even after the relationship ends
  • Implement adequate security measures
  • Strictly comply with professional secrecy

6. Liability

6.1 Professional Liability

VS Advocacia is liable for damages caused by willful misconduct or gross negligence in the exercise of professional activity, under the terms of law and professional liability insurance.

6.2 Limitations

  • We do not guarantee specific results in court proceedings
  • We are not responsible for judicial or administrative decisions
  • We do not assume responsibility for incorrect client information
  • We limit liability for acts of God or force majeure

9. Relationship Termination

9.1 Mandate Renunciation

VS Advocacia may renounce the mandate in cases provided by law and the Bar Association Statute, with adequate notice.

9.2 Client Revocation

The client may revoke the mandate at any time, and must pay fees for services already provided.

9.3 Document Archive

Documents are kept for the legal period of 20 years, and may be collected by the client upon request.

10. Final Provisions

10.1 Applicable Law

These terms are governed by Portuguese law, namely:

  • Bar Association Statute
  • Civil Procedure Code
  • Civil Code
  • General Data Protection Regulation

10.2 Competent Forum

For dispute resolution, the Lisbon district court is competent, with express waiver of any other.

10.3 Changes

These terms may be changed at any time, with changes communicated through the website and applicable to new contracts.

10.4 Partial Nullity

The possible nullity of any clause does not affect the validity of the remaining provisions.
